The Program on Information Justice and Intellectual Property at American University Washington College of Law is pleased to announce that effective April 20, 2021, it has assumed stewardship of the Open COVID Pledge (opencovidpledge.org).  The Open COVID Pledge was conceived by a volunteer steering committee in March 2020 and launched on April 7, 2020.  Since then, an estimated 500,000 patents and multiple copyrights have been publicly pledged to the COVID-19 response.  The Open COVID Pledge was hosted and stewarded by Creative Commons during its first year of operation.

The Program on Information Justice and Intellectual Property is a public Interest intellectual property program at the American University Washington College of Law.  Initiated by Senior Policy Fellow Jorge Contreras in 2013, PIJIP also hosts an ongoing project on patent pledges, including a public database of pledges. In addition to Contreras, the Open COVID Pledge steering committee is co-chaired by Diane Peters, Senior Policy Fellow at PIJIP and a co-founder of the Pledge, and Meredith Jacob, PIJIP’s Assistant Director for Academic Programs.

As an important part of our stewardship of the Open COVID Pledge, we are pleased to announce that the Pledge is now available in all six of the official languages of the United Nations: Arabic, Chinese, English, French, Russian, and Spanish. This increases accessibility and usefulness of the Pledge to more than 3.7 billion persons in their first or second languages. We are also excited to be launching a simple translation process through which any member of our community can contribute translations of the Pledge in other languages at our upcoming 2020 CC Global Summit.

Understanding and communicating the value of the Pledge is a critical part of encouraging companies, universities, research teams, and others to contribute their valuable IP to help solve COVID-19 quickly. As we begin working with the CC Global Network to increase the Pledge’s reach and secure additional Pledges, we’ll also be working with our community to translate information and adoption guides as they become increasingly important.

These are the first internationalization efforts that CC is undertaking since we announced our leadership of the OCP work in August—but they’re certainly not the last. In addition to launching the simplified translation process, we’ll also be discussing advocacy and outreach techniques at next week’s CC Global Summit, where we’ll be gathering our community’s ideas for how they can contribute to this effort. We’ll also be identifying tools that will assist with outreach both to those who hold valuable intellectual property as well as those seeking to use the IP that is pledged at that workshop on Wednesday, October 21. In addition, founders of the OCP will provide an informational overview of the OCP project for newbies on Tuesday, October 20, where companies that have adopted the pledge will share their reasons for joining. Finally, watch for us to announce an expansion of the CC OCP Advisory Council early next year to ensure better international expertise and diversity.

In combination and alongside other collaborations, we expect these efforts will scale the OCP internationally to create critical mass and impact. We’re pleased to announce today that Creative Commons is taking on leadership and stewardship of the Open COVID Pledge.

This transition is made with the strong support and encouragement of the OCP Steering Committee, which will continue on in an advisory capacity as the project progresses. This is a natural fit for Creative Commons given the organization’s mission of enabling sharing, creativity, and innovation, and reinforces our commitment to the longevity, stability, and success of the project.

We’re looking forward to using Creative Commons’ experience, resources, and worldwide community of experts (the Creative Commons Global Network) to expand the scope, reach, and impact of the project. We’re already working with leading organizations in the international arena working on copyright and IP policy, such as the WHO and other UN bodies.

We believe this initiative will have a profound impact beyond the COVID-19 pandemic. The common set of values, tools, and principles for the responsible use of IP in the public’s interest formed during this particular crisis can and should be used as a necessary model for addressing other crises, such as climate change. The Covinhood™ (U.S Patent Pending) is a protective device against oral bioaerosols for use by dental patients. This device is made from an 18.9L clear water bottle, designed to assist dentists and dental hygienists with significant needs for additional protection against oral bioaerosols during a pandemic, with a shortage of Personal Protective Equipment (PPE). 

The Covinhood™ is equipped with four openings: one for the patient’s head (orange filter glasses); two others, one on each side for the hands and instruments of the dentist or dental hygienist; and the last, the normal bottle opening, for the connection of the antistatic hose associated with the suction and filtration system with HEPA (0.3 micrometer).

There are a number of software applications that require authentication. For example, many e-commerce, home banking, and network access applications need to verify the user for security purposes. In most cases the user needs to enter a text-based password or passphrase. During the COVID-19 pandemic, there is increased demand for no-touch systems, especially on shared computer systems (e.g., bank ATMs, building entry systems, etc). This patent claims a system where user authentication is accomplished through gestures. The system identifies the pattern (like a signature) drawn by the user in 3D space and uses it for authentication.

Providing technologies that localize occupants of a building will be needed for effective contract tracing as societies try to manage and contain the spread of COVID-19.
